Diane Nygaard was named the "Consumer Advocate of the Year" for 2005 for her work in several class actions in which insurance companies repaid minorities for millions of dollars in excess fees it had charged for life insurance. These race discrimination cases were filed in Kansas City, New York, and New Orleans and have been settled for an amount in excess of $300 million. The firm is currently representing people who were overcharged in obtaining mortgage refinancing from E*Trade Mortgage Corporation.
The firm has been especially involved in additional cases involving fraud in the sales of insurance products, including annuities. It has represented many individuals who were sold annuities through misrepresentations and unclear and misleading sales presentations. Some of these cases have been handled for individual people who were retired, and the firm has collected millions of dollars in lost retirement savings due to annuities in individual or group lawsuits and in arbitration. The firm is currently working on a new putative class action alleging fraud in the use of the term "upfront" bonus to sell annuities. We are also currently investigating the practice of selling long-term deferred annuities to seniors.
